Inheriting a home means completing procedures within a short time, at a moment that is rarely easy. It helps to know them, to avoid surcharges or losing tax benefits.
Inheritance tax in Madrid and Andalusia
The tax is national but run by the regions, which approve their own advantages. In Madrid, TaxDown cites a 99% allowance for children, spouses and ascendants, and 50% for group III since July 2025. In Andalusia, the regional agreement provides 99% for spouses and direct relatives. The rules depend on your relationship and on where the deceased lived.
A costly mistake
A low expected bill does not exempt you from filing. As TaxDown notes for Madrid, failing to file can cost you the allowance as well as surcharges.
Usual deadlines
- Inheritance tax: six months from death, with an extension available if requested within the first five.
- Municipal plusvalía: six months, extendable to one year if requested in time.
Other steps
- Death certificate and last wills certificate, plus the will or declaration of heirs.
- Deed of acceptance before a notary.
- Recording at the Land Registry.
- Change of holder for property tax and with the community.
If you later want to sell
The acquisition value is usually the one declared in the inheritance, so it affects your future gain. Seek advice before filing: it is one of the decisions with the most lasting effect.
